This article reviews an appeal filed in the Supreme Court against an order of the Commercial High Court of the Western Province. The High Court’s order, delivered in October 2010, refused to vacate an ex-parte judgment entered against the Defendant-Petitioner-Appellant, Kala Traders (Pvt.) Ltd., in default, as per Section 86(2) of the Civil Procedure Code.
